Abstrakty

Artykuł został poświęcony kontroli zgodności z konstytucją przepisów ustawy w prawie austriackim. Przedmiotem artykułu jest szczegółowe zagadnienie, odnoszące się do tzw. kontroli konstytucyjności ustawy przez Austriacki Trybunał Konstytucyjny. Kontrola ta oparta jest o kryterium kontroli: tzw. niezgodności z konstytucją. Problematyce tej został poświęcony cały art. 140 Federalnej Konstytucji Austrii. Jeżeli ustawa zostanie uchylona wyrokiem TK, jako niezgodna z konstytucją, to z dniem wejścia uchylenia poprzez jej ogłoszenie następuje stan zgodności z konstytucją. Skutek dla systemu prawa jest opisany w wyroku TK, dlatego też sądy i urzędy administracji publicznej zgodnie z art. 140 ust. 7 zd. 1 oraz art. 139 ust. 6 zd. 1 Konstytucji związane są orzeczeniem TK od chwili jego opublikowania. The article has been devoted to constitutional review of the act in the law of Austria. The subject of the article is a detailed matter referring to the so-called constitutionality review of the act by the Austrian Constitutional Tribunal. The review is based on the control criterion: the so-called inconsistency with the constitution. This issue has been discussed in the entire art. 140 of the Austrian Federal Constitution. The Constitutional Tribunal (CT) in Austria adjudicates on the basic review criterion, that is constitution. If the act is repealed by way of the verdict due to being at variance with the constitution, the compliance with the constitution is restored on the day of revocation through announcement. The effect on the law system is described in the verdict of CT, therefore courts and government administrative offices become bound by the CT's verdict upon its publication pursuant to the art. 140 para. 7 clause 1 and art. 139 para. 6 clause 1 of the Constitution.
