Zalecenia - akty niewiążące o wiążących skutkach?

Abstrakty

Zalecenia sugerują adresatowi odpowiednie zachowanie, nie nakładając na niego obowiązku prawnego. Znaczenie zalecenia jest więc polityczne i moralne. Przewidując taki rodzaj aktu prawnego, ojcowie traktatów założyli, że adresaci zaleceń, biorąc pod uwagę prestiż i znaczenie instytucji unijnych oraz ich szczególną pozycję i ponadnarodowy charakter, dobrowolnie wprowadzą ich postanowiennia w życie. Artykuł pokazuje, że zalecenie ma coraz częściej wiążący, choć oczywiście pośrednio, charakter.
