The commercial bank in accordance with the Congolese banking law is a specialized financial institution and engaged in the operation and organization of the flow of money between individuals and companies for their direct consumption or willing to invest. The commercial banks are independent and are financed by themselves because they are organizational units with legal personality acting on base to the Ordinance Law No. 13/001 of 23 February 2001 on the nomenclature of taxes and charges of the provinces and decentralized territorial entities - changing the precedence order - Act No. 87-004 of 10 January 1986. The basic tasks include fundraising, loans and cash payments on domestic and foreign markets. In the Democratic Republic of Congo the commercial bank is considered a business is an organization designed primarily for lucrative profits, that is to say, profits, and performing operations that involve predetermined financial risks such as bank accepts customer deposits and borrowed money more expensive for customers who are checked seekers credits. Banki komercyjne zgodnie z kongijskim prawem bankowym to wyspecjalizowane instytucje finansowe trudniące się obsługą i organizowaniem ruchu pieniądza między jednostkami gospodarującymi i ludnością. Banki komercyjne są samodzielnymi samofinansującymi się jednostkami organizacyjnymi posiadającymi osobowość prawną działającymi na podstawie ustawy Nr 13/001 z dnia 23.02. 2006 r. zmieniającą ustawę Nr 87-004 z dnia 10.01.1986 r. Podstawowe zadania banków komercyjnych to gromadzenie środków pieniężnych, udzielenie kredytów i pożyczek oraz dokonywanie rozliczeń pieniężnych w obrocie krajowym i zagranicznym. W Demokratycznej Republice Konga bank komercyjny jako przedsiębiorstwo jest organizacją nastawioną przede wszystkim na zysk, prowadzącą równolegle różnego typu działalności, wykonującą operacje z którymi wiąże się określone z góry ryzyko finansowe (Powiedzenie, że w sposób najprostszy można określić, iż bank przyjmuje depozyty od klientów i pożycza te pieniądze drożej innym zweryfikowanym klientom jest przynajmniej mylne). Banki kreują pieniądze, dzięki czemu przyjmując do depozytu daną kwotę pieniędzy są w stanie pożyczyć zależnie od sytuacji nawet kilkadziesiąt razy więcej niż przyjęły do depozytu). Działają w sposób precyzyjny i posiadają szczegółową dokumentację organizacyjną (regulaminy, schematy organizacyjne itp.). W Demokratycznej Republice Kongu przyjęło się, że celem banku komercyjnego jest dążenie do zaspokojenia potrzeb podmiotów gospodarujących w zakresie usług bankowych przy równoczesnym dążeniu do uzyskania zysku. Obecnie banki komercyjne można również podzielić na uniwersalne, czyli takie, które realizują wszystkie podstawowe operacje, i wyspecjalizowane, czyli koncentrujące się na określonych operacjach. Do banków komercyjnych należą banki hipoteczne, zgodnie z przepisami koncentrujące się na udzielaniu kredytów zabezpieczonych hipoteką na nieruchomości. Banki komercyjne odgrywają kluczową rolę w kongijskim systemie bankowym. Przypada na nie około 94% depozytów zebranych przez wszystkie banki i także około 94% udzielonych kredytów bankowych.
