W teorii i praktyce prawa pracy problematyka prawna płacy jest ograniczona do pracowniczego zatrudnienia i nie uwzględnia związku płacy z finansowaniem zabezpieczenia społecznego oraz wydatkami budżetu na cele społeczne. Prowadzona jest polityka zatrudnienia taniego z punktu widzenia interesu pracodawcy, co narusza konstytucyjną normę demokratycznego państwa prawnego urzeczywistniającego zasady sprawiedliwości społecznej i zasadę ustroju opartego na społecznej gospodarce rynkowej. Zdaniem autora potrzebne jest nowe ujęcie płacy - jako kategorii prawnej obejmującej wszystkie formy zatrudnienia oraz płacową (składkową i podatkową) daninę w konstrukcji płacowego obowiązku o mieszanym charakterze publiczno-prywatnym. The question of wage from employment has a narrow legal tradition limited to typical labour law employment and contract private law obligation and, additionaly, is placed far from financing social security from all wage related duties (social insurance contribution, PIT, as well as indirectly also VAT and excise). Arguments are presented in favour of a large conception of forms of employment and an indispensible obligatory wage of a mixed public-private character which satifies all sources of the employee and his family socially adequate income.
