Abstrakty
Ekonomiczna analiza praw własności intelektualnej powinna uwzględniać interesy nie tylko twórców czy wydawców, ale też właścicieli platform internetowych oraz użytkowników. Katalizatorem rozwoju otwartego modelu nauki, kultury i edukacji jest rozwój nowych, powszechnych form komunikacji, np. łączności mobilnej, serwisów społecznościowych, i nowych form kontroli korzystania z utworów. Nowe technologie wpływają również na ekonomiczny sens ochrony praw autorskich - celowe jest bardziej elastyczne podejście do systemów ochrony tych praw. Przeważa pogląd, że w obliczu rozwoju internetu nadmierny rygoryzm, penalizacja pośredników czy użytkowników nie leżą w interesie interesariuszy. Można rekomendować legalizację pewnych praktyk, których skuteczna kontrola nie jest możliwa - trzeba jednak uczynić to w taki sposób, by nie demotywować twórców i nie blokować dyfuzji wiedzy. Kluczowy jest stopień oraz charakter wkładu użytkownika w treści utworu, cel dzielenia się utworami, a także liczba osób, którym można udostępniać dane treści. Problemy mogą wynikać z mieszania różnych form utworów - za zgodą pierwotnego autora. Adaptacje czy remiksy trzeba odróżniać od korzystania z odnośników, cytatów i kopiowania na własny użytek, do czego zgoda autora nie jest wymagana. W ocenie prawnej należy brać pod uwagę: cel przeróbki, nadanie danemu dziełu nowego wyrazu artystycznego, uwzględnienie nowej wiedzy itp. Program UE Digital Agenda zakłada stworzenie jednolitego rynku treści cyfrowych opartych na licencjach wieloterytorialnych, szerokopasmowym szybkim internecie i interoperacyjności oprogramowania. Powinno to służyć maksymalizacji społecznego i gospodarczego potencjału technologii ICT. (abstrakt autora)

The premise for choice of the research problem is the impact of new technologies on directions in the discussion of copyright l aw. The goal is the integrated look at the regulation of the market of new technologies in the context of intellectual property rig hts. The method of research is the analysis of the law, case law and literature. It must be concluded that the economic analysis of inte llectual property rights should take into account not only the interests of authors and publishers, but also the owners and users of onl ine platforms. New technologies have an impact on the economic sense of copyright protection - it is appropriate to suggest a more flexible approach to systems of protection of these rights. (original abstract)
