Abstrakty

Przedmiotem rozważań zawartych w artykule jest proces decyzyjny w Radzie Unii Europejskiej, a szczególnie poziom i sposób kontestowania przez państwa członkowskie aktów prawnych procedowanych na forum tej instytucji. Pod pojęciem "kontestowanie" będziemy rozumieć wstrzymanie się od głosu lub zgłoszenie sprzeciwu przez członka Rady podczas formalnego głosowania, jak również brak akceptacji dla aktu w wyniku procedury tzw. shadow voting. Wraz z postępującym poszerzaniem oraz pogłębianiem procesu integracji europejskiej wzrasta znaczenie decyzji podejmowanych w Unii Europejskiej dla realizacji interesów państw oraz dużych grup społecznych. Rada Unii Europejskiej (Rada UE), organ międzyrządowy, należy do głównych ośrodków decyzyjnych i wywiera bardzo duży wpływ na kształt tworzonego tam prawa. Jednocześnie pozycja państwa w Unii Europejskiej jest silnie determinowana umiejętnością i możliwościami oddziaływania na wynik procesu wspólnego podejmowania decyzji. Celem artykułu jest dokonanie, w oparciu o przeprowadzone badania, weryfikacji hipotezy zakładającej, że decyzje w Radzie podejmowane są przede wszystkim w drodze konsensualnych negocjacji, nie zaś głosowania. This article presents not only an empirical analysis of the voting records of the Council of the European Union, but also an analysis of the acts that have not been passed and therefore represents an innovative approach to research on the voting practice in the Council of the European Union. The aim of this paper is to further our empirical knowledge of the Council decision-making process by examining a data set consisting of all acts proceeded in the Council from 2005 to 2006. The data confirm that generally the Member States made collective decisions by consensual negotiations, even in the 80 per cent cases where they could activate voting, and that the new Member States contested votes less often than the old ones.(original abstract)
