A Consumer in Pronouncement of Anti-monopolistic Court

Abstrakty
Każda praktyka monopolistyczna godząca w regóły wolnej konkurencji uderza jednocześnie w konsumenta. Omówiono niektóre sprawy o charakterze prokonsumenckim, które toczyły się przed Sądem Antymonopolowym. Były to głównie sprawy przeciwko monopolistom naturalnym (elektrociepłownie, telekomunikacja, poczta, wodociągi, przedpłaty na samochody).
The article "A consumer in pronouncement of Anti-monopolistic Court" presents public-legal problems of consumer protection i.e. not so much the protection of his/her individual interest but rather his/her market position, taking into account general public interests. It should be added that the act on counteracting monopolistic practices, although ammended on August 8 1996, does not contain too many regulations whose aim is to protect the interests of a consumer. The article discusses lawsuits of clearly pro-consumer character taken against natural monopolists and other entities which are being dealt with by Anti-monopolist Office and Anti-monopolist Court. The review of pronouncements includes cases where Telekomunikacja Polska S.A. and water-supply and sewage companies were the charged parties as well as cases involving power supply enterprises, car manufacturers and construction corporation. It should be underlined that the article is only a symptomatic selection of the most interesting cases and verdicts. (original abstract)
