Abstrakty
Stwierdzono, że w aktualnym stanie prawnym przedsiębiorcy podlegają różnorodnym wpisom do rejestrów i ewidencji gospodarczych. Część z nich ma na celu ustalenie statusu prawnego przedsiębiorcy przez jego otoczenie (rejestry przedsiębiorstw, spółdzielni, spółek i ewidencji nie mających osobowości prawnej przedsiębiorców), część ma znaczenie głównie dla odpowiednich organów administracji rządowej i samorządowej (rejestr gospodarki narodowej, NIP). Zwrócono uwagę na ustawę z dnia 20 sierpnia 1997 roku o Krajowym Rejestrze Sądowym wprowadzającą z dniem 1 stycznia 2001 r. określone ramy dla działania jednolitych rejestrów przedsiębiorców i jednolite zasady postępowania przy rejestrowaniu przedsiębiorców.
By law, businesses are subject to a variety of registration requirements. Some entities, however, are not subject to any registration. The existing business registers and records are legally restricted to specific categories and entities. Non-corporate entities, for instance, are entered in business registers but not in court registers. Yet, court registers do keep a record of corporations, i.e. of artificial persons. Registers vary by business type, as do the laws mandating their establishment and the effects of their use. Certain restrictions are in place on the access of third parties to some of them, such as commercial registers. The existence of freely accessible resisters has certain implications such as that all data is accurate and up-to-date. Another implication is that all the other entities are aware of the entries made. The National Court Register Act of 1997 will take effect as of January 1, 2001. The Act will uniformly regulate issues related to registration and will result in the registration of all businesses. Its advanced provisions will certainly contribute to more secure administration over businesses and their immediate business environments.(original abstract)
