Abstrakty

Omówiono podstawy prawne prowadzenia działalności gospodarczej przez gminę. Dokonano charakterystyki pojęcia "działalność gospodarcza gmin". W tym celu porównano pojęcia "działalność gospodarcza gmin" i "działalność gospodarcza" w rozumieniu ustawy o działalności gospodarczej oraz przedstawiono zakres, a także formy działalności gospodarczej gmin.

The purpose of this paper is to provide an overview of issues related to the engagement of municipalities in business. The topic is not and was not intended to be fully exhausted. Some issues are merely touched upon, others, such as that of communal property, were not even raised. The limited scope of this paper prevented the author from discussing all isues related to municipalities' engagement in business. The issues are definitely noteworthy, especially in view of the legislative reform driven by the rise of local governments. The process will reduce the role played by the central administration and lead to increased delegation of powers to local governments. Thus, municipalities will have increasingly more responsibilities toward members of local communities. In meeting their goals, municipalities are often forced to engage in business. Here, their business knowledge will certainly be essential. It is therefore critical to structure such knowledge and the author hopes he has made a significant contribution in this area.(original abstract)
