Structure of the Foreign Capital Involved in the Polish Insurance Market in 1995-1998

Abstrakty
W artykule dokonano porównania przewidzianych przez niemieckie prawo dwóch rodzajów prywatnych zakładów ubezpieczeń: spółki akcyjne i towarzystwa ubezpieczeń wzajemnych. Scharakteryzowano pierwotny model towarzystwa ubezpieczeń wzajemnych, małe i duże TUW. Omówiono proces zanikania różnic między TUW a ubezpieczeniowymi SA, ich pozycję prawną i umocowania ustawowe, politykę techniczno-ubezpieczeniową oraz politykę finansową ubezpieczyciela oraz dokonano porównania wad i zalet ubezpieczeniowych towarzyst wzajemnych i ubezpieczeniowych spółek akcyjnych z punktu widzenia teorii zarządzania.
The article characterises briefly the above-mentioned two legal forms of carrying out insurance activities: MIC (including the division between small and large mutual insurance companies) and JSIC> Later on the article describes how the differences between MIC and JSIC gradually disappear. The analysis includes legal, organisational, underwriting equity aspects as well as those connected with finances. While discussing the problem of capital the author presents widely debated in Germany hypothetical ways of solving the problem of raraising their equity also by mutual insurance companies. Advantages and disadvantages of MIC and JSIC are listed from the viewpoint of the theory of management. The final part of the paper is devoted to a brief analysis of competition between MIC and JSIC in the light of advertising campaigns carried out by those companies. (short original abstract)
