W 1990 r. ustawodawca polski zlikwidował niemal wszystkie ograniczenia obrotu gruntami rolnymi, co pozbawiło władze państwowe prawnych instrumentów oddziaływania na strukturę agrarną. Kraje Unii Europejskiej systematycznie rozwijają kontrolę obrotu gruntami rolnymi, choć posiadają już prawidłową strukturę agrarną, natomiast Polska mimo wyjątkowo rozdrobnionej struktury agrarnej całkowicie liberalizuje obrót ziemią rolniczą. W rezultacie, w 2000 r. polskie rozwiązania prawne w zakresie obrotu gruntami, bardziej niż w 1989 r. odbiegają od unijnych standardów.
In the 1990 the Polish legislature eliminated almost all restrictions on the sale and purchase of arable land as a result of which the government authorities were deprived of any legal instruments that could help them influence the arable land structure. It is difficult to understand the reasons behind the choice of such legislative solutions. The EU countries (and Poland is aspiring to become member of the UE) keep developing control systems for the sale and purchase of arable land, even though their arable land structure is good, yet Poland is becoming quite liberal about the sale and purchase of arable land despite its extremely dispersed structure. As a result in the year 2000 the Polish legislation complies in this respect with the EU standards to a lesser extent than it did in 1989.(original abstract)
