The Characteristics, Assessment and Prospects of the Special Protection of Employment Stability of Employees Performing Public and Civic Functions

Abstrakty
Zadaniem państwa demokratycznego jest umożliwienie obywatelom łączenia aktywności społecznej lub obywatelskiej z rodzajem wykonywaniej pracy zawodowej. Zadanie to, jest realizowane m.in. poprzez szczególną ochronę trwałości stosunku pracy osób pełniących funkcje społeczne i będących równocześnie pracownikami. Autor przanalizował przesłanki wiązania z funkcjami społecznymi i obywatelskimi szczególnej ochrony stosunku pracy i rozpatrzył kwestię współistnienia zasady swobody kontraktowej stron stosunku pracy oraz zasadę ochrony trwałości stosunku pracy. Scharakteryzował ponad to zakres podmiotowy i przedmiotowy szczególnej trwałości ochrony stosunku pracy. Na koniec podjął próbę oceny obowiązujących rozwiązań prawnych regulujących ochronę i nakreślił perspektywy szczególnej ochrony stosunku pracy w nowych regulacjach prawnych.
One of the legal solutions that support public activities of the citizens is the special protection of employments stability of employees performing public and civic representative functions. The basic role of this regulation is to protect the employee against the adversary effect of the activities connected with his function upon his relations with the employer and to make possible the effective and independent performance of the function. A chracteristic of public activity is that it potentially generates conflicts. The source of conflicts can be above all a conflict of group interests with the employer's intrests and the employee's subordination to the employer, typical of the employment relation. A prerequisite for the acqusition by the employee of the right to special protection of the stability of employment is his being elected to perform a public or civic function that is entitled to protection. With some functions the right to protection applies only to the time of its de facto performance, with other cases during its term and some time after its termination. The future model of special protection depends of the economic system in Poland. In the model of a liberal market economy, interdictions of and special restrictions on the termination of employment should be reduced to the minimum while the means of appeal implementing protection should be flexible. With a social market economy it can be assumed that the existing model of protection will be preserved. The direction goal should be a further application of the solution aiming at the 'professional' performance of functions. (short original abstract)
