Praca zawiera analizę problematyki prawnej pojęcia czasu pracy. Analiza ta obejmuje regulację pojęcia czas pracy przede wszystkim w przepisach polskiego prawa pracy, incydentalnie zaś dyrektywach Wspólnoty Europejskiej oraz przepisach prawnych innych państw. Autor przedstawia zarys pojęcia czas pracy. Wskazuje możliwości i konieczność jego uelastycznienia. Zarysowuje nowy model regulacji znacznie poszerzający obecnie obowiązujący w Polsce.
The monograph is an extensive analysis of the definition of working hours that is in force in Poland. The first two chapter concerns the understanding of the definition of working hours. The second discusses the social and economic significance of the issues in question. The third chapter includes a legal analysis of the definition of working hours that is operation. Chapter fourth talks about untypical situations when an employee has to be at an employer's disposal, a legislator accepts certain periods as working hours. Chapters 6 and 7 describe the relation of the definition of working hours to other institutions of labour law. Chapter 8 presents an alternative employment in the light of the discussed issues. The conclusion of the thesis comprises two parts. The first one includes a few de la ferenda comments. The second specifies the situations when an employee remains at an employer's disposal. The thesis may be used as a material for doctrine and jurisdiction in the description of institutions related to working hours. This will result in the uniform and consequent application of the regulations concerning the definition of working hours. Furthermore, the dissertation aspires to influence the regulation of working hours in the future for it is the author's conviction that there are plenty of legal and axiomatic shortcomings in the present legislation.
