Abstrakty

Artykuł 255 Traktatu ustanawiającego Wspólnotę Europejską (TWE) przewiduje dostęp każdego obywatela Unii Europejskiej oraz osób fizycznych i prawnych do dokumentów Parlamentu Europejskiego, Rady i Komisji. W artykule przedstawiono zakres przedmiotowy prawa do dokumentów oraz rozwój prawa dostępu do dokumentów. Przybliżono rozporządzenie nr 1049/2001 regulujące zasady dostępu do dokumentów.

A new right of access to documents of three Community institutions (Commission, European Parliament and Council of the European Union) was introduced by art. 255 of the Treaty on the European Community in its Amsterdam version. This might be seen as a step towards greater democratisation and transparency within the European Union. This article presents the background of this development. It mainly examines the jurisprudence of the European Court of Justice concerning the access to documents and the way it was followed up by the Regulation 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents. That retains most of the input created by the Court's activity. Although the development of this new right is considered as very positive phenomenon, some doubts are raised by the fact that it only concerns three of all Community institutions. Bearing in mind the constant criticism for the lack of democracy within European Union, there seems to be a strong need for the greatest transparency possible in actions of each and every Community body and not only the most prominent ones.(original abstract)
