Zadaniem opracowania jest zwrócenie uwagi na praktyczne konsekwencje rozbieżności jakie pojawiają się w określaniu instytucji kredytowej na gruncie prawa polskiego i europejskiego.

The purpose of this article is to draw attention to the practical consequences of the discrepancies in the definition of credit institution under European law and in domestic practice. Errors are very easy to commit in this terminological chaos, and as a consequence undermine customers' trust in the banking system. It appears that it is precisely the question of properly identifying a given entity as a credit institution that is of key importance. In this article, the author analyses the following issues: credit institutions and financial institutions under Community law, credit institutions and financial institutions under Polish law, the substantive scope of the concept of "credit institution" under Community law and the substantive scope of the concept of "credit institution" under Polish law. In conclusion, it should be asserted that introducing, on the basis of law, a private concept of "institution" in a substantive approach is not justified and, what is more, does not fulfil the conditions of propriety and cohesion of the system. It is also not prescribed by Community law. It appears that the term "credit enterprise" proposed in this study meets all the conditions of propriety and cohesion of the legal system - similarly to the term "bank." (original abstract)
