Abstrakty

Omówiono problematykę nowych uregulowań prawnych zapewniających jakość kosmetyków. Przedstawiono zagadnienie dotyczące nomenklatury składników kosmetycznych oraz zaprezentowano instytucje zajmujące się w Unii Europejskiej jakością kosmetyków.

Since 1991 Poland has been the associate member of the European Union, and at present it is its full member. Thus, the country is obliged to harmonize its regulations with those of the EU, both from the formal point of view and the real application of the law. The elementary requirement is to adjust Polish regulations to those being in force in the EU, as well as to assure high quality of goods so that they could compete with foreign products. The new law on cosmetics of March 30, 2001 was based on the requirements of the European Cosmetics Directive 761768/EEC as its main objective was to adjust the Polish law to that of the European Union. However, the acceptance of a new regulation in that field resulted also from the fact that the requirements regarding cosmetics production were inadequate to the new state of knowledge, and the goods turnover terms of those days created obstacles to international trade. The European, common nomenclature makes it possible to identify substances, due to the use of only one name in all the EU member countries. In consequence, it makes it possible to eliminate easily the substances which should be omitted by consumers with allergy, or it can be useful in other cases. This is connected with the obligation to place on the packaging information about the cosmetics ingredients. According to the new regulations, the market control system, i.e. the system operating after goods have been introduced into the market, is more effective than preliminary admission procedures. The control is exercised by specially constituted “competent organs”, who are authorized to take samples of goods from the market, at any time, in order to test them in official laboratories for the conformity with the EU regulations. If necessary, they can also verify information about the controlled products provided by a producer or an importer (original abstract).
