Abstrakty

Coraz silniejsze powiązanie rozwoju gospodarczego z widmem radiowym, wzmocnione przez proces konwergencji technologicznej i rozwój technik unikania zakłóceń, w coraz większym stopniu oddziałuje na trendy gospodarki tym ograniczonym zasobem. Poddaje presji administracyjny model „dziel i rządź", w którym gospodarka widmem jest scentralizowana i zorientowana na władcze przesądzanie w indywidualnych sprawach o zasadach wykorzystywania widma. Następstwem powyższego są postulaty „uwolnienia", czyli liberalizacji widma, przynajmniej w części przeznaczeń cywilnych. Na nią z kolei składają się trzy wzajemnie przenikające się procesy - urynkowienia przydziałów (rezerwacji) częstotliwości, propagowania modelu wspólnoty widma i jego neutralności (technologicznej i usługowej). Wszystkie ze wskazanych procesów zyskują na znaczeniu zarówno na gruncie unormowań prawnych, jak i polityki regulacyjnej. Aktywność wykazują w tej materii wiodące organy regulacyjne oraz międzynarodowe gremia wyspecjalizowane w harmonizacji gospodarki widmem. Rok 2007pokazał, że procesy te w coraz większym stopniu zaczynają wpływać także na zasady gospodarki widmem w Polsce. (abstrakt oryginalny)

The ever stronger interrelationships between the economic growth and the radio spectrum, propelled by the process of technological convergence and the development of interference avoidance techniques, influence yet more remarkably the management trends for this scarce resource. The trends insert pressure on the administrative "command-and-control" model in which the spectrum management is centralized and oriented towards prescriptively defining, in individual cases, the way spectrum should be used. As a corollary, claims to "liberate" the spectrum arise, at least in a part of civil allocations. Liberalization comprises three interwoven processes: merchandizing spectrum assignments, promoting the spectrum commons model and the (technological and services) neutrality. Ali the abovementioned processes gain importance both in legal terms and in the language of regulatory policies. Leading administrative authorities, as well as international bodies specialized in the spectrum management harmonization, are active in the field. The year 2007 has demonstrated that the processes increasingly influence the rules of spectrum management in Poland as well. (original abstract)
