Importance of Insurance for a Commune on the Basis of Act on Fire Protection

Abstrakty
Omówiono obowiązki odszkodowawcze gminy wynikające z ustawy o ochronie przeciwpożarowej. Zwrócono uwagę na możliwość transferu obowiązków odszkodowawczych gminy na ubezpieczyciela, a także na obowiązek ubezpieczania członków ochotniczej straży pożarnej oraz młodzieżowej drużyny pożarniczej.
Amended fire act (in force since 01 January 2004 year) obliges communes to pay compensations. This duty concerns harm of firemen - members of a voluntary fire brigade. The harm must happen during rescue operations or fire exercises. A commune pays compensation if the injury is durable (persist more than 6 months). Moreover, a commune is obliged to pay for death or damage to property. The compensations for the injuries may have a very high level and therefore cause financial trouble for a local government. There is a place for insurance companies that can offer insurance products protecting communes against considerable claims. Local governments are very interested in entering into such agreements. Moreover, they are obliged to insure firemen but the fire act doesn't specify the range of insurance. (original abstract)
