Abstrakty
Autor omówił zmiany jakie wprowadza traktat lizboński w obszarze przestrzeni wolności, bezpieczeństwa i sprawiedliwości (PWBiS). Zaprezentowano dodatkowe dokumenty dołączone do traktatu lizbońskiego, takie jak: protokoły, załączniki i deklaracje. Przedstawiono wyjątki i rozwiązania szczególne wprowadzone w ramach PWBiS, a także przeprowadzono ocenę zmian, które zostały wprowadzone traktatem lizbońskim w obszarze PWBiS.
On 13 December 2007 in Lisbon, the Member States signed the Treaty Reforming the European Union. This event completed a long period of political negotiations and wide discussions on the future tasks, objectives and role of the improved EU as well as overtook a relatively serious crisis after failure of the Constitutional Treaty's ratification. One of the key amendments of the already existing European infrastructure of policies concerned the Area of Freedom, Security and Justice (AFSJ). The article highlights the most important features of agreed changes (like an abolition of pillars within AFSJ, enhanced role of European Court of Justice, new decision-making model based on co-decision instead of unanimity, introduction of new bodies like Internal Security Committee and European Public Prosecutor, etc.) as well as scrutinises some of the exceptions to the general rules (including the modified enhanced cooperation mechanism, safeguard clause concerning the maintenance of public order and security within the territory of the Member States that falls outside AFSJ and competence of ECJ as well as remained and extended specific status of the UK, Ireland and Denmark). Disregarding the positive evaluation concerning the amendments introduced by the Treaty of Lisbon, this paper also shares some doubts and fears concerning possible loopholes and problems in the process of implementing a new ASFJ regime. Finally, the article looks forward concerning an estimated practice of the Member States with great deal of sympathy. (original abstract)
