Abstrakty
Przedmiotem artykułu jest analiza dodatku aktywizacyjnego, jednego z instrumentów rynku pracy, przewidzianego w ustawie o promocji zatrudnienia i instytucjach rynku pracy, który w obecnym stanie prawnym jest sui generis nagrodą za wykazanie przez osobę posiadającą status bezrobotnego inicjatywy świadczenia pracy zarobkowej. Obowiązujące uregulowanie jest adresowane do nielicznego grona osób, przez co ma charakter niszowy. Autor postuluje radykalne poszerzenie katalogu podmiotów uprawnionych do świadczeń z tytułu dodatku aktywizacyjnego, co uczyniłoby ten instrument rynku pracy uniwersalnym narzędziem promocji szeroko rozumianego zatrudnienia. The study presents the analysis of an activating addition of labour market instruments, which is provided in law about employment promotion and labour market institutions. In thought of definition contained in law, the activating addition is the sum which is paid the unemployed person with right to allowance. Further more, the person should undertake work by himself or herself in result of referral by district office of work. How it comes from introduced definition, the subject who can apply for the benefit is exclusively person who opts out of the employed person’s status to take the allowance in support of work which is undertaken on the strength of stipulation. Moreover, the activating addition as the instrument of labour market has assignment to activate unemployed people. However, it needs to be given some thought that the limitation of applying of this legal constructions for subjects is wide. In addition, the legislator did not decide to value the initiative of unemployed people without the right to allowance, who found the employment by themselves, without help of district work office and who did not increase catalogue of people, who the instrument of labour market is made for. Moreover, legislative passivity in this filed astonishes because the activating addition is the only instrument of labour market which is used obligatory. Taking everything into account, it can be affirmed the thesis that the activating addition promotes employment only for a few circle of subjects. The analysis of statistics data presents how large difference is between quantity of unemployed person with the right to allowance and unemployed people without the right. In year 2006, there were 310 828 unemployed people entitled to allowance on 2 309 410 unemployed registered people and in year 2007 there were suitably 250 633 entitled people on 1 746 537 registered. In 2008 year, the numerical relation was 271 269 to 1 473 752. It is hard to accept the fact that legislator appreciates initiative of undertaking work by people who can give up the right to take the allowance and creativity of people who do not have the right to allowance is unconcerned by legislator. In that connection, it is seemed that the idea of people circle, whose initiative of undertaking work will be reasonably promoted, is legitimate. That legislation more is essential the activating addition will promote ex lege employment and other paid work of all unemployed active people and which will not be only some prize for a few people.
