Umowa użyczenia jest regulowana przez Kodeks cywilny. Omówiono rozwój tych przepisów od pojawienia się ich w Rzymie w ostatnich wiekach republiki, poprzez prejudykaty statutów Kazimierza Wielkiego, Kodeksu Napoleona, austriackiego kodeksu cywilnego do dzisiejszych czasów.

A lending agreement is one of the liability agreements regulated by the Civil Code. In this article, the author attempts to present the development of regulations concerning such agreements, which had already appeared in Rome in the last centuries of the Republic as a separate mature legal institution. Many of the solutions that currently exist in the regulations on lending agreements can be traced back to the original form of this agreement. Analysis of the subsequent development of lending leads us to the normalising regulations contained in the Prussian National Law, the Napoleonic Code, the Austrian Civil Code or the Collection of Laws of Imperial Russia, up until the regulations contained in the main Draft of the Code of Obligations, the Code of Obligations itself, and finally in the Civil Code. To present current regulations on lending agreements also requires taking into account the Act of 21 June 2001 on the protection of tenants' rights, local authority housing stock, and amendments to the Civil Code. For this Act is important when analysing the sources of lending agreements in Polish civil law. This is because the regulations of the Civil Code concerning lending agreements were formed with movable property in mind. The provisions of the Act on the protection of the tenants' rights supplement the regulations of the Civil Code to account for situations where the subject of the lending agreement is property. It was therefore necessary to indicate the basis for applying the regulations contained in the Act on the protection of the tenants' rights to lending agreements and to indicate whether these regulations will relate to every property lease/rental agreement.
