One of the most contentious issues in Polish-Jewish relations since World War II, both nationally and internationally, has proved to be the inviolability of Jewish cemeteries. At the root of the controversy lies a clash between the dictates of the Jewish religion, which treats cemeteries as inviolable (sacred), and various legal promulgations that at different times have provided for their closure or liquidation to free the land for other projects. It is such clashes and the efforts to solve them that are the focus of the present article. The time-span considered is from the first attempts to recreate Jewish religious life after the Holocaust (Autumn 1944) to the 1991 law on the inviolable status of denominational cemeteries. The discussion proper is preceded by an overview of the Jewish religious community in Poland after the war, whose voice was the most consistent among Jewish organizations in advocating the sacredness of cemeteries. The present article is based on the extensive records kept at the New Document Archive (AAN) and at the Jewish Historical Institute of Warsaw (ZIH), and on what scant literature exists.
