The EU climate policy has become the most important branch of the EU environmental policy. A critical review on the theoretical basis of the EU climate policy based on the new institutional economics approach is the aim of the paper.Protection of the atmosphere due to high social costs of pollution requires introduction of appropriate regulation. The analysis presented in the paper proves that following theoretical considerations pressure groups have enormous influence on the EU climate policy evolution especially concerning the Emissions Trading System. It means that while preparing negotiation strategies on the EU climate policy the decision makers cannot ignore the pressure groups also those active at the EU level. (original abstract)
