Abstrakty

Celem opracowania jest omówienie najważniejszych zakazów i nakazów formułowanych przez islam, odnoszących się bezpośrednio lub pośrednio do finansów oraz wskazanie na skutki ekonomiczne tychże zakazów i nakazów. "Skutki ekonomiczne" obejmują pozytywne i negatywne efekty o charakterze czysto ekonomicznym wywoływane przez ograniczenia o charakterze religijnym. (fragment tekstu)

The last decade has seen an unprecedented growth not only in the practice of Islamic finance but also in the literature on this topic. Islam has constrained the freedom to engage in business and financial transactions on the basis of a number of prohibitions, ethics, and norms. The goal of this paper is to address the issue of major prohibitions in Islamic finance and their consequences for Islamic financial contracts. They should be namely free of components of riba, gharar, and maysir. The author discusses the positive and negative consequences of applying these restrictions to financial instruments as well as Sharia-compliant modes of profit-and-loss sharing, which constitute or should constitute the backbone of future Islamic economic system. The paper is based both on current literature and on discussions with practitioners from two major Islamic financial centres: Bahrain and Kuala Lumpur. (original abstract)
