Abstrakty
Status osoby niepełnosprawnej uprawnia do szeregu udogodnień związanych z codziennym funkcjonowaniem w społeczeństwie. Treścią tych udogodnień są w szczególności preferencyjne zasady kształtowania stosunku pracy, ułatwiony dostęp do pomocy w znalezieniu zatrudnienia, otwarcie drogi do praw z zabezpieczenia społecznego, podejmowania działalności gospodarczej, a także ułatwiony dostęp do rehabilitacji oraz terapii. Tytułem prawnym legitymującym do wszystkich tych uprawnień jest rozstrzygnięcie właściwego organu administracji publicznej. (fragment tekstu)
The subject of the case study is a question of judicial review and control over rulings in the disabled persons cases. Legislator has established a set of professional bodies of public administration - units regarding the disabled cases. However he has not settled in a uniform way whether the legality of their judgemental practices will be reviewed by administrative courts or by a common court within general jurisdiction. The author differentiates the rulings into: these made by district units and these made by voivodship ones. Types of rulings are also listed in accordance with this platform: judgements, decisions and resolutions, indicating that each procedural mode of judicial control is dependant on the qualification within one of these procedural forms. This article is an endeavour in order to determine a distinction of ways of creating an administrative relationship in each type of ruling, emphasising the existence of: reformatory competency of common court as well as limited extent of reviewing a ruling when an administrative courts' jurisdiction is excluded. It is also proven which motives existed to make the legislator exclude jurisdiction of administrative courts regarding the disabled persons' cases, leaving the final judgment in the hands of a common court.
