Abstrakty

Organy administracji publicznej działają w rozmaity sposób w zakresie układania stosunków z obywatelami, zarówno podejmując działania faktyczne, jak i podejmując czynności prawne o zróżnicowanym charakterze. Znamienitym jest, iż działania organu administracji publicznej muszą mieć swoje odzwierciedlenie normatywne w obowiązujących przepisach prawa, zarówno nakładając obowiązki na obywateli, jak i przyznając im uprawnienia. In the article "Administrative recognition or administrative evaluation? Study on a provision of art. 50 sec. l of act from 1986 Law on birth, marriage and death certificates" the author compares a notion of the administrative recognition with a notion of the administrative evaluation - on grounds of doctrinal opinions in this scope, which generally divide the notion of the administrative recognition into its narrow and wide understanding and separate them from the notion of the administrative evaluation. The author's attention also focuses on the status of unspecified notions in aspect of the administrative evaluation construction. The author investigates the above notions on grounds of a provision of art. 50 sec. l of act from 1986 Law on birth, marriage and death certificates, stating that distinguishing between the narrow and wide understanding of the notion of the administrative recognition - in the context of occurring of unspecified notions in legal norms -does not have any ground in the above mentioned provision of art. 50 sec. l, from which it results that a public administration organ refuses to accept a statement on choosing for a child among others a ridiculing, diminutive name or name in a diminutive form. The author proves that establishing which name can occur in a diminutive form does not display features of valuation and a possibility of choice by an administrative organ of equivalent administrative and legal solutions, and it is limited to establishing the meaning of notions contained in a legal text in the context of a referred factual state, as well it does not constitute the administrative recognition in its narrow sense, but it is included in a process of law interpretation. The author also proves that it is difficult to determine which name may therefore ridicule or be indecent, because these are blunt or undefined expressions, which are translated in a language by other legal undefined expressions and because of that one must agree that measure of the public administration organ - in the context of evaluation whether a given name may ridicule or be indecent - will bear features of the administrative recognition in the wider understanding, despite the fact that the legislator did not express directly authorisation for the administrative organ to use the administrative recognition with help of an expression e.g. "can" and constructed a provision of art. 50 sec. 1 quite categorically by a disposition:,, the registrar refuses to accept a statement on a choice for a child (...) a ridiculing or indecent name (...)."
