Zagadnienie mniejszości narodowych i ochrony ich praw jest aktualnym problemem stosunków międzynarodowych. Rzeczpospolita Polska zawarła dotychczas 23 umowy o przyjaźni i współpracy, spośród których 14 zawiera klauzule o ochronie mniejszości narodowych. W niniejszym artykule poddano analizie treść tych klauzul na tle europejskich regulacji w zakresie ochrony mniejszości narodowych. (fragment tekstu)

The paper presents an overall view of the bilateral treaties on cooperation and good neighbourly relations concluded by the Republic of Poland. Among 23 agreements, 14 contain provisions concerning the protection of national minorities. They differ in terms of structure and the range of guaranteed rights, however, certain treaties show similarities. Most of the treaties are based on the Polish-German agreement concluded in 1991, which is often regarded as a model agreement in bilateral interstate relations. All of the treaties refer to international documents concerning the protection of national minorities, while a great number of them directly incorporate the international provisions, providing them with binding legal force. Presented analysis focuses on the notion of the national minority and the person belonging to national minority. The following comparison of guaranteed cultural, political, social and economic rights reveals the level of granted protection. This one varies from the very high and compliant with the international standards concerning the protection of minorities (treaties with Germany, Belarus, Lithuania) to general and ambiguous provisions included in other treaties (e. g. with Hungary, Romania, Bulgaria). The case of the Polish minority, however, leads to a conclusion that the satisfying level of the granted protection does not necessarily mean effective protection in practice. This is due to the fact that the implementation of the treaties depends mostly on the political good will of according states, as they all lack the effective implementation mechanisms. Nevertheless, the importance of the bilateral treaties on cooperation should not be diminished. They substantially contribute to building stability in Europe through creating a framework for protection of national minorities, adapted to individual needs of respective minorities.
