The acceptance of the 1095 canon into the new Code of Canon Law in 1983 has been accompanied by relatively frequent guidelines by popes regarding the mental causes of nullity of marriage. The Roman bishop per-forms them from his position of the supreme power in the Church, particularly in order to protect the Church community from being scandalized by seeing practical destruction of the values of Christian marriage due to exaggerated and almost automatic declaration of nullity of marriage in the event of Martin Kakalej the failure of the marriage on the pretext of immaturity or mental weakness of either spouse. The popes, particularly John Paul II. and Benedict XVI., in their homilies for the Roman Rota at the beginning of the calendar year, used to deal with the issue of mental incapacity of sacramental marriage. The aim of this thesis is therefore to analyse these pope guidelines on mental disabilty and to draw conclusions for practice.(author's abstract)
