Abstrakty

Celem artykułu jest przybliżenie czytelnikowi pojęcia należności ciążących na przesyłce użytego w przepisie art. 51 ust. 1 ustawy z dnia 15 listopada 1984 r. - Prawo przewozowe (dalej pr. przew.), który stanowi, że "Przez przyjęcie przesyłki i listu przewozowego odbiorca zobowiązuje się do zapłaty należności ciążących na przesyłce". Wspomniany przepis jest sformułowany w sposób niezwykle lakoniczny. Przede wszystkim nie wynika z niego - podobnie jak z pozostałych przepisów ustawy Prawo przewozowe - co należy rozumieć przez pojęcie "należności ciążące na przesyłce".(fragment tekstu)

Article 51.1 of Polish Transport Law of 15 November 1984 states that "By reason of his acceptance of the goods and the consignment note the consignee undertakes to pay the charges and other expenses chargeable against the goods". The provision is formulated in a rather laconic way. Because of that, the provision causes many problems with its interpretation which were reviewed in many decisions of the Supreme Court of Poland. The author presents how the position of the Supreme Court has been evolving. She points out that the judgments of the Supreme Court do not solve the ethical problems which are caused by the said provision. The author also presents views of other authors who do not accept the Supreme Court's position. They approve another interpretation of the said provision. According to the author their interpretation is more accurate and it corresponds with the rules of modern economy. At the end the author stresses the need for change of the said provision.(original abstract)
