Abstrakty

W artykule podjęto próbę analizy idei rządów prawa oraz relacji pomiędzy różnym stopniem realizacji zasady rządów prawa a szybkością rozwoju gospodarczego. Omówiono różne rozumienie terminu "rządy prawa". Zwrócono uwagę, że rządy prawa nie muszą być rozumiane jako rządy prawa stanowionego (ustanawianego przez państwo). Podano przykład Somalii jako społeczeństwa, w którym panują rządy prawa, choć od 1991 r. społeczeństwo somalijskie funkcjonuje bez rządu i państwa (w rozumieniu kultury Zachodu). Przedstawiono wyniki badań różnych zespołów badawczych, dotyczących zależności pomiędzy jakością rządów prawa a rozwojem gospodarczym. (abstrakt oryginalny)

The main aim of this paper is to answer the question to what extent the level of economic development as well as the rate of economic growth depend on the presence of rule of law in worldwide societies. Different understandings of the 'rule of law' are presented in the first section. This is followed by the discussion related to the problem of mutual dependence of 'rule of law' and the state legislation. The main conclusion of the discussion is that it is possible to image existence of society without the state imposed law. The case of Somali society is presented as an example of stateless society with strong governance of rule of law. In the last section the results of different research teams on relationship between quality of rule of law and economic development are presented. (original abstract)
