Przedstawione rozważania dotyczące konwergencji wybranych systemów prawnych, choć zilustrowane wybranymi jedynie przykładami z zakresu zagadnienia ciężaru dowodu w prawie pracy, pozwalają zauważyć tendencję polegającą na dążeniu do harmonizacji prawa w poszczególnych państwach członkowskich. Konwergencja prawa jest osiągana za pomocą wielu rozmaitych metod i środków. Niebagatelną rolę w tym procesie odgrywają m.in. prawo unijne (w tym istotne dyrektywy), działalność orzecznicza TSUE, konwencje MOP. (fragment tekstu)

The term convergence can be used in several senses. It can be perceived as a part of the process of globalisation, but it may also denote the process of harmonisation of legal systems. I would like to draw my attention to the convergence of selected national legal systems which results from the European and international law. I will focus on the reversal of the burden of proof by rebuttable presumptions of law: formal - such as the presumption of innocence stated in article 6 paragraph 2 of The European Convention on Human Rights and article 14. 2 of the 1966 International Covenant on Civil and Political Rights, which also applies to employment law; material - the presumption of employment relationship in Directive 2009/52/EC of the European Parliament and of the Council of 18 June 2009 providing for minimum standards on sanctions and measures against employers of illegally staying third-country nationals. Moreover, article no. 4 of Council Directive 97/80/EC of 15 December 1997 on the burden of proof in cases of discrimination based on sex and other European Union directives provide the "shared" burden of proof - between employee and employer. The latter proves that there has been no breach of the principle of non-discrimination. The obligation to provide information to the other party can facilitate the burden of proof. The harmonisation is reached by the Council Directive of 14 October 1991 on an employer's obligation to inform employees of the conditions applicable to the contract or employment relationship (91/533/EEC). Legal fictions do not require a proof. There is only a need to declare the existence of the conditions specified in law for the realisation of this legal structure. I will give some examples of legal fictions: Article 4. 2 of Council Directive (EC) 2001/23 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses; clause 5 of Council Directive (EC) 1999/70 concerning the framework agreement on fixed-term work concluded by ETUC, UNICE and CEEP. I will give some other examples of the directives referring to the burden of proof. I would not omit the ILO Convention no. 158 concerning termination of employment at the initiative of the employer (article 9. 2a concerning the burden of proof). 36 countries have ratified the convention. We can observe its impact on the national regulations even in the countries which have not ratified the convention. (original abstract)
