Przedstawiono rozważania w zakresie przedmiotu referendum lokalnego i statusu prawnego uczestników takiego referendum.

The text titled "Municipal referendum - chosen problems" constitutes considerations concentrating mainly on the subject scope of the municipal referendum and on a legal status of participants of the municipal referendum. The following matters are included in the subject scope of the municipal referendum: self-taxation of inhabitants for public aims, dismissal of the municipal council before the end of its term and also head of the commune (mayor, city president) and every other matter embraced in the scope of tasks and competencies of the commune. The subject of referendum can be tasks realised both by the commune board and head of the commune. Carrying out the referendum is permissible in matters referring to the commonwealth included in the scope of tasks and competencies of agencies of a given entity, therefore issues comprised in the scope of tasks and competencies of agencies of the given entity but which do not have direct connection with the community property, are not qualified to be solved in a way of referendum. In the light of scientific opinions one can surely admit to participants of the referendum the quality of the municipal authority. However, with reference to a question whether the participants of the referendum are the municipal agency, one should maintain far-reaching caution, because art. 11 sec. 1 as well as art. 11 a of Act on Municipal Self-government directly exclude the commune inhabitants (participants of the referendum) from the circle of the municipal agencies. It also seems that one of the basic features of the agency is a certain continuity, regularity of activity, which is lacking in case of the participants of the municipal referendum.
