Celem artykułu jest analiza efektywności pracowniczych praw człowieka na przykładzie migrantów, biorąc za punkt wyjścia typologię dzielącą unormowania międzynarodowe dotyczące pracy jako przedmiotu praw człowieka na cztery grupy: prawa związane z zatrudnieniem (np. zakaz niewolnictwa i pracy przymusowej, prawo do ochrony przed bezrobociem), prawa wywodzące się z zatrudnienia (np. prawo do zabezpieczenia społecznego, prawo do sprawiedliwych i korzystnych warunków pracy), prawa dotyczące równości traktowania i niedyskryminacji oraz prawa instrumentalne (np. prawo do organizowania się, prawo do strajku czy prawo do rokowań zbiorowych). Autorka, dostarczając dowodów na tzw. współczesne niewolnictwo, hiper-prekariat i dyskryminację, wykazuje niewystarczającą efektywność pierwszych trzech grup praw. (abstrakt oryginalny)

The aim of the article is to examine the effectiveness of human labour rights on the example of migrants, taking as a starting point typology which divides international standards concerning labour as a matter of human rights into four groups: rights relating to employment (eg. the prohibition of slavery and forced labour, the right to protection against unemployment); rights deriving from employment (eg. the right to social security, the right to just and favourable conditions of work); rights concerning equal treatment and non-discrimination, and instrumental rights (eg. the right to organise, the right to strike, and the right to collective bargaining). The author of the study - providing evidence of so-called modern slavery, hyper-precariat and discrimination - shows insufficient effectiveness of the first three groups of rights.
