Abstrakty

Prawidłowa wykładnia zawartego w art. 50 ust. 1 ustawy o planowaniu i zagospodarowaniu przestrzennym odesłania do odpowiedniego stosowania przepisu art. 61 ust. 1 pkt 4 tej ustawy wymaga wyważenia racji, wyrażonych zarówno w ustawie o wspieraniu rozwoju usług i sieci telekomunikacyjnych, ale także w ustawie o ochronie gruntów rolnych i leśnych. The commentary is critical, indicating the unequal treatment by the Supreme Administrative Court in the judgment under review of two separate statutory regulations that needed to be taken into account in the process of the systemic interpretation of Article 50, para. 1 of the ASPM and its reference to the respective application of Article 61, para. 1, item 4 of the ASPM. Giving priority to the provisions of the Act on the support of the development of telecommunications services and networks while completely ignoring the regime of the protection of agricultural land was not justified by the court in any way.
