Autor przedstawia zmiany wprowadzone digitalizacją prawa pracy, pod którym to pojęciem rozumie procesy społeczne i zmiany technologiczne dokonujące się w przepisach prawa pracy w epoce czwartej rewolucji przemysłowej w społeczeństwach postindustrialnych. Uważa, że w erze postindustrialnej konieczne są zmiany w przepisach prawa pracy, dla których czynnikiem odróżniającym pracę wykonywaną w ramach stosunku pracy od pracy świadczonej na podstawie umów cywilnoprawnych oraz w ramach działalności prowadzonej na własny rachunek jest instytucja prawna podporządkowania pracownika pracodawcy. Taki podział zatrudnionych na pracowników i niepracowników zakłóca równowagę między osłoną socjalną, konkurencyjnością i elastycznością instytucji rynku pracy. Autor omawia platformy pracy jako przykład digitalizacji zatrudnienia. Analizuje podstawy i ramy prawne zatrudnienia osób korzystających z ich pośrednictwa. Podkreśla, że z wyjątkiem Francji w innych państwach Unii Europejskiej nie uregulowano statusu zatrudnionych za pośrednictwem tych platform. (abstrakt oryginalny)

The Author presents changes made by the process of digitalisation in the mandatory labour standards which are in the period of the fourth industrial revolution incompatible with labour market flexibility and efficiency. The legacy of the ancient master-servant model of a contractual labour regulation makes it difficult to restore equilibrium in the current labour market on which a better balance between social protection, competitiveness and employment flexibility ought to be found. He advocates a tendency to employ reflexive techniques under the human being in charge to lead and control modern processes of reconciliation the various demands between latour law and economic efficiency in the period of the automation, artificial intelligence and other structural chan ges introduced to postindustrial society. This paper identified common types of platform work and examines the employment and working conditions of workers engaged in various types of platform work. Except France there is no specific regulation of employment status of platform workers in any of the UE Member States. (original abstract)
