Nowadays, there is an increasing incentive for trade unions to try to ensure respect for trade unions not only at home but also abroad. This article compares labour rights in a relatively new instrument, the International Framework Agreements (IFAs) between a Global Union Federation and a Multinational Corporation with an already more established one, with labour clauses in US Free Trade Agreements (FTAs). In both instruments trade unions are involved, in the last instrument only in a consultative capacity. The question is also whether IFAs, which are the (exclusive) domain of trade unions, are a more legitimate instrument than FTAs from the point of view of empowerment of trade unions. This article will compare the two instruments in terms of the role of trade unions involved in the formulation of the instruments, the instrument's content and follow-up mechanisms provided, in order to see whether they create similar or different outcomes in terms of empowerment. A new concept is introduced: empowerment-enhancing legitimacy. (original abstract)
Współcześnie występują coraz silniejsze bodźce dla związków zawodowych, aby zapewnić sobie szacunek nie tylko w kraju, ale również zagranicą. W niniejszym artykule porównano prawa pracy zawarte w relatywnie nowym instrumencie, jakim są międzynarodowe porozumienia ramowe (ang. International Framework Agreements - IFAs) pomiędzy jedną z globalnych federacji związkowych (ang. Global Union Federation - GUF) a korporacją międzynarodową z instrumentem w większym stopniu przyjętym, mianowicie klauzulami pracowniczymi zawartymi w porozumieniu o wolnym handlu (ang. Free Trade Agreements - FTAs), którego stroną są Stany Zjednoczone. W obu tych przypadkach zaangażowane są związki zawodowe, przy czym w drugim instrumencie wyłącznie jako siła doradcza. Rodzi się tutaj następujące pytanie: czy IFAs, będące (wyłączną) domeną związków zawodowych, są z punktu widzenia wzmocnienia związków zawodowych instrumentem w większym stopniu usankcjonowanym aniżeli FTAs? W niniejszym artykule dokonano porównania obu instrumentów pod względem roli, jaką odgrywają zaangażowane w nie związki zawodowe w procesie formułowania zarówno samych instrumentów, jak i ich założeń, a także mechanizmów kontrolnych. Cel analizy porównawczej stanowi próba określenia, czy kreują one takie same czy też odmienne skutki w zakresie umacniania związków zawodowych. Wprowadzono również nowe pojęcie, jakim jest prawowitość sprzyjająca wzmocnieniu (ang. empowerment-enhancing legitimacy). (abstrakt oryginalny)
