Międzynarodowe prawo humanitarne przyznaje szczególną ochronę pewnym kategoriom osób. Jedną z nich jest personel duchowny, wśród którego wyróżnić można m.in. kapelanów. Przydzieleni do sił zbrojnych celem pełnienia posługi duszpasterskiej i oddający się całkowicie pełnieniu tej funkcji, nie mogą być w żadnym miejscu i czasie przedmiotem ataku. Przedmiotową ochronę tracą wówczas, gdy zaangażują się w działania wrogie lub szkodliwe dla nieprzyjaciela. Niniejszy artykuł zawiera omówienie poszczególnych funkcji, jakie pełnią kapelani wojskowi podczas współczesnych działań zbrojnych, równocześnie analizując je w pryzmacie norm prawa humanitarnego. Badaniu, w kontekście zgodności z przyznanym tej grupie statusem niekombatanta, poddano również wybrane problemy natury prawnej oraz faktycznej, z którymi kapelani mogą się zetknąć na polu walki - w tym celu poruszona zostaje między innymi budząca spory, kwestia możliwości posiadania i używania przez nich broni.(abstrakt oryginalny)

International humanitarian law (IHL) grants a special regime of protection to certain categories of specific personnel. One such group entitled to special treatment is military chaplains. If they are attached to the armed forces and exclusively engaged in religious duties, they must be respected and protected in all circumstances. They lose their protection if they commit acts harmful or hostile to the enemy. The main goal of this article is to provide a complex examination of the specific functions and selected legal issues of chaplains' status during combat operations. The paper discusses challenges that chaplains face on the modern battlefield, with particular reference to the right of bearing arms and evaluates if the problematic issues can be efficiently reconciled with their non-combatant status.
