Artykuł zawiera przegląd rozwiązań prawnych w zakresie kapitałowego zaangażowania rolników w procesie prywatyzacji przedsiębiorstw sektora rolno-spożywczego. Autor omawia udział rolników w procesie prywatyzacji przedsiębiorstw według głównych metod prywatyzacji (prywatyzacja pośrednia, prywatyzacja bezpośrednia, program NFI, prywatyzacja przemysłu cukrowniczego).
This paper presents legal aspects of the capital participation of the farmers in the privatisation process of polish state-owned enterprises of the agricultural-consumption branch. Here are presented the possibilities of the capital participation in three main paths of privatisation (direct privatisation, indirect privatisation, National Investments Founds). Since the beginning of the transformation in Poland the farmers were participated in the ownership structures of the privatised enterprises of the agricultural-consumption branch. In the beginning the farmers could buy shares for preference price (half price) and late they could get free (preference) shares. The right to get free (preference) shares have only farmer who cooperated with the privatised company. The capital participation the farmers in the privatisation process is limited. They could get only 15 procent total shares of privatised companies. It should be added, that farmers sell their shares to other investors. (original abstract)
