Abstrakty

Artykuł przedstawia wybrane zagadnienia statusu prawnego organów gminy w polskim i we francuskim porządku prawnym i ich wzajemne relacje: personalne i funkcjonalne. Analizie poddano podstawowe płaszczyzny relacji organów władzy we wspólnocie lokalnej w oparciu o sposób wyboru organu wykonawczego oraz zestawienie kompetencji wójta/mera w odniesieniu do kompetencji rady gminy w obu porządkach prawnych. Analiza determinantów funkcjonowania organów stanowiących i wykonawczych ma na celu przedstawienie kierunków zmian w zakresie doskonalenia modelu organów gminy, co stanowi wyzwanie dla współczesnego samorządu terytorialnego, dla którego efektywność działania władzy jest najistotniejszym wyznacznikiem sprawnego zarządzania wspólnotą lokalną. The article presents selected issues concerning the legal status of municipal authorities in the Polish and French legal order and their mutual relations: personal and functional. The basic areas of the relations of the authorities in the local community were analysed based on the manner of electing the executive body and based on the competencies of the mayor in relation to the competencies of the municipal council in both legal orders. The aim of the analysis of the determinants of the functioning of the legislative and executive bodies is to present the directions of changes in terms of improving the model of municipal authorities, which is a challenge for contemporary local governments, for which the effectiveness of power is the most important determinant of efficient management of the local community.
