Abstrakty

W przeciwieństwie do wielu innych obszarów prawa celnego naruszenia przepisów celnych podlegają nielicznym regulacjom koordynacyjnym o zasięgu międzynarodowym i unijnym. Niemniej jednak Trybunał Sprawiedliwości UE zdołał ustanowić ogólne zasady, które mogą służyć za wskazówkę dla prawodawców oraz sądów państw członkowskich, o czym świadczy przypadek Włoch, gdzie zastosowanie europejskiej zasady proporcjonalności doprowadziło do restrykcyjnej interpretacji krajowych przepisów dotyczących sankcji celnych.(abstrakt oryginalny)

In contrast to many other areas of customs law, customs infringements are subject to few international and EU coordinating rules. Nevertheless, the EU Court of Justice has been able to establish general principles capable of guiding the legislators and jurisprudence of each Member State, as witnessed by the Italian case, in which the application of the European principle of proportionality has led to a restrictive interpretation of the domestic customs sanctions regulations.(original abstract)
