Abstrakty

Na podstawie przedstawionych przykładów zdaniem autora Trybunał Konstytucyjny nie kieruje się w swoim orzecznictwie regułą sprawiedliwości rozdzielczej "każdemu według pozycji". W orzecznictwie Trybunału uznanie zyskuje koncepcja sprawiedliwości dystrybutowej natomiast wybór reguły sprawiedliwości rozdzielczej zależy od przyjętego kryterium rozdziału dóbr.

The subject of the present considerations in the presentation of the position of the Constitutional Tribunal as regards the concept of distributive justice (iustitia distributiva). The author discusses numerous decisions of the Tribunal in which the criterion decisive of whether a given act was or was not in agreement with the Constitution is the general clause expressed in article 2 of the Constitution of the Polish Republic concerning the principle of social justice. The considerations presented have the character of theoretical analysis, yet they concern the matters of great practical significance as one of the principles of the distributive justice is the formula "to each in accordance with his or her deeds", also expressed as "to each in accordance with his or her labor".
